Terms of Service

1. Acceptance of Terms

These Terms of Service are an agreement between you and UALLY CO LLC, a company registered in Tbilisi, Georgia, operating as Unifically ("Unifically", "we", "us"). By accessing and using Unifically's services, you accept and agree to be bound by these terms. You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering into a binding contract to use our services.

2. Service Description

Unifically provides AI-powered API services including but not limited to:

• Video generation and processing
• Image creation and manipulation
• Audio and music generation
• Text processing and AI language models

3. User Accounts

Users must create an account to access our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment, Balance and Refunds

Our services operate on a pay-per-use, pre-paid basis. You must maintain a positive account balance to use our APIs.

Your balance. Your account balance is a pre-paid usage entitlement, displayed in US dollars for pricing visibility only. It is not money held on your behalf and gives you no claim to cash: it is redeemable solely for services on this platform, and is non-withdrawable and non-transferable between accounts. Balance may also be added through promotions, referrals and bonuses, so it does not necessarily correspond to any amount paid. Balance does not expire.

Failed requests. You are charged only for successfully completed requests. Failed generations are not billed.

Refunds.

• All balance purchases are final, non-refundable, and non-transferable, except as set out below or where required by applicable law.
• Promotional balance, referral balance, and any balance received free of charge is non-refundable at all times, as no payment was made for it.
• We will issue a refund for duplicate charges, billing errors, balance rendered unusable by a verified technical failure on our side, and in any other circumstances where a refund is required by consumer protection law applicable to you.
• To request a refund, email support@unifically.com from the address on your account with the transaction reference. Eligible requests are reviewed and processed within 5 to 10 business days, returned to the original payment method. Payment processing fees may be deducted where applicable.

Before purchasing. Every new account receives free balance so you can try models before paying, and you can top up in small amounts at any time. We recommend confirming a model meets your needs with the free balance or a small top-up before purchasing more.

Consumer rights. Nothing in this section excludes, restricts or modifies any right or remedy you may have under consumer protection law applicable to you that cannot lawfully be excluded.

5. Acceptable Use

Users agree not to use our services for:

• Illegal activities or content
• Generating harmful, offensive, or inappropriate content
• Violating intellectual property rights
• Attempting to reverse engineer or compromise our systems
• Generating, distributing, or storing child sexual abuse material (CSAM). This is strictly prohibited and will result in immediate account termination and reporting to authorities

We may suspend or terminate accounts that violate these terms. Balance on accounts terminated for breach of these terms is forfeited.

6. Service Availability

While our goal is to deliver high availability, we do not guarantee uninterrupted or error-free service, and service performance may vary. Your feedback is valuable and helps us improve. We reserve the right to modify, suspend, or discontinue any aspect of our service at any time, with or without notice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Unifically shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services, and our total liability arising out of or relating to the services shall not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

8. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes. If you do not agree with the updated terms, you may stop using our services and request deletion of your account by contacting support@unifically.com. Continued use of our services after an update constitutes acceptance of the modified terms.

9. Governing Law

These terms are governed by the laws of Georgia, and any dispute arising out of or relating to these terms or our services shall be resolved in the courts of Tbilisi, Georgia, except where consumer protection law applicable to you provides otherwise.
